Terms of Service

These Terms of Service ("Terms") govern your access to and use of the KizunaX AI API platform, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

By creating an account or using any part of the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Services. We may update these Terms from time to time, and continued use after changes constitutes acceptance.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

Your use of our APIs is subject to the rate limits, quotas, and usage policies associated with your subscription plan. You may not exceed allocated limits, use the APIs for illegal purposes, attempt to reverse-engineer our systems, or resell API access without authorization.

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, APIs, and software — are owned by KizunaX and protected by international copyright, trademark, and other intellectual property laws. You retain ownership of data you submit through the APIs.

Paid plans are billed in advance on a monthly or annual basis. Credits are non-refundable and expire at the end of each billing cycle unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.

To the maximum extent permitted by law, KizunaX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Services.

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

We may suspend or terminate your access to the Services at any time, with or without cause, upon notice. You may terminate your account at any time by contacting support. Upon termination, your right to use the Services ceases immediately, and we may delete your data after a reasonable retention period.

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Da Nang, Vietnam.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on our platform at least 30 days before taking effect. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
